{"id":2105,"date":"2009-08-05T08:16:00","date_gmt":"2009-08-05T08:16:00","guid":{"rendered":"https:\/\/transintersexhistory.africa\/?p=2105"},"modified":"2024-09-16T11:36:55","modified_gmt":"2024-09-16T11:36:55","slug":"august-2009-court-rules-in-favour-of-gay-and-lesbian-film-festival-south-africa","status":"publish","type":"post","link":"https:\/\/transintersexhistory.africa\/august-2009-court-rules-in-favour-of-gay-and-lesbian-film-festival-south-africa\/","title":{"rendered":"August 2009 \u2014 Court Rules in Favour of Gay and Lesbian Film Festival, South Africa"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.facebook.com\/outinafricaFF\/\">Out in Africa (OIA) Gay and Lesbian Film Festival<\/a> won <a href=\"https:\/\/transintersexhistory.africa\/gay-and-lesbian-film-festival-sues-the-south-african-film-and-publications-board-south-africa\/\">its case against the South African Film and Publications Board<\/a> to <a href=\"https:\/\/www.atlanticphilanthropies.org\/news\/oia-win-case-argentinas-xxy\">unban the film <em>XXY<\/em> in August 2009. <\/a><\/p>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" width=\"683\" height=\"1024\" src=\"https:\/\/transintersexhistory.africa\/wp-content\/uploads\/2024\/06\/XXY-683x1024.jpeg\" alt=\"\" class=\"wp-image-3680\" style=\"width:400px\" srcset=\"https:\/\/transintersexhistory.africa\/wp-content\/uploads\/2024\/06\/XXY-683x1024.jpeg 683w, https:\/\/transintersexhistory.africa\/wp-content\/uploads\/2024\/06\/XXY-200x300.jpeg 200w, https:\/\/transintersexhistory.africa\/wp-content\/uploads\/2024\/06\/XXY-768x1152.jpeg 768w, https:\/\/transintersexhistory.africa\/wp-content\/uploads\/2024\/06\/XXY.jpeg 960w\" sizes=\"(max-width: 683px) 100vw, 683px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">At the <a href=\"https:\/\/transintersexhistory.africa\/gay-and-lesbian-film-festival-sues-the-south-african-film-and-publications-board-south-africa\/\" data-type=\"post\" data-id=\"2089\">end of February<\/a> of that same year, OIA argued in court against the initial decision to ban the film was <a href=\"https:\/\/mg.co.za\/article\/2009-03-05-child-porn-to-be-debated\/\">based on discrimination<\/a>, because the Board\u2019s definition of child pornography should then by the same measure not allow films such as <em>Lolita<\/em>, <em>American Beauty<\/em>, <em>Death in Venice<\/em>, and <em>Romeo and Juliet<\/em> to be screened in South Africa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The claim was supported by the <em><a href=\"https:\/\/fxinstitute.org.za\/\">Freedom of Expression Institute<\/a><\/em>, and the application was further supported by the well-known intersex activist, <a href=\"https:\/\/transintersexhistory.africa\/the-first-african-intersex-organisation-formed-south-africa\/\">Sally Gross<\/a>.<a href=\"https:\/\/www.atlanticphilanthropies.org\/news\/oia-win-case-argentinas-xxy\"> <\/a>After the lawsuit,&nbsp; <em>XXY<\/em> was added to the line-up of films to be screened at the 16<sup>th <\/sup>Annual Film Festival in September 2009.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-4-3 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe title=\"XXY - Trailer - Peccadillo\" width=\"1328\" height=\"996\" src=\"https:\/\/www.youtube.com\/embed\/Xoul_HT4K84?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">Trailer for <em>XXY<\/em><\/figcaption><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>The Out in Africa (OIA) Gay and Lesbian Film Festival won its case against the South African Film and Publications Board to unban the film XXY in August 2009.
